Under section 22 (i) & (ii) of the Assam Tenancy (Temporarily Settled Areas) Act, 1971, the Govt. may vest the rights, titles and interests of any or all landlords in respect of any holding held and personally cultivated by Occupancy Tenants/ Under-Tenants in the hands of the respective Occupancy Tenants/ Under-Tenants free from all encumbrances.
Under Section 23 (i) & (ii) of the Assam Tenancy (Temporarily Settled Areas) Act, 1971, any Occupancy Tenants/Under-Tenants (cultivating holdings prior to Tenancy Act, 1971) personally cultivating the land of his Tenancy, desirous of acquiring the Ownership Right of his land lord may at any time make an application in writing to the Deputy Commissioner and on such application being made and compensation as provided in Section 25 is determined and paid by the Occupancy Tenants/ Under-Tenants, the Deputy Commissioner shall declare the said Occupancy Tenants/ Under-Tenants to have acquired the Ownership rights free from all encumbrances.
